Intervention de Celestina Caccianiga, doctorante en droit, Université de Salerne:

« Bivalve fisheries in northen Adriatic : a successful integrated co-management system. Legal and normative issues. »

Celestina est accueillie à AMURE pour 5 mois dans le cadre d’un programme de coopération entre l’UBO et l’Université de Salerne. Elle est accueillie par Bertrand Le Gallic avec qui elle a déjà travaillé dans le cadre du projet SUCCESS au sein de NISEA. Sa spécialité est le droit commercial, le titre (provisoire) de sa thèse est « L’entreprise de pêche : formes juridiques et perspectives de développement ». Bertrand et Fabienne introduiront la présentation de Celestina à partir d’une courte présentation permettant de situer son travail dans des problématiques plus générales d’AMURE sur la question du développement historique, des liens entre gestion des stocks et commercialisation, etc…

Presentation : The scholarship of Celestina is granted by the Italian Ministry of education within a project which was set in order to enhance the cooperation between the Italian and foreign universities (in the specific case, French ones) and also national enterprises. The topic of her PhD research deals with the structures and perspective of development of fishery enterprises, mainly from a legal point of view, more precisely regarding the running of the business by means of organisations (cooperatives and consortia) or associations (Producers’ Organisations or Associations). In the previous semester the research focused on a case study explored by NISEA, private research firm based in Salerno and also partner of the EU project SUCCESS (Strategic Use of Competitiveness towards Consolidating the Economic Sustainability of the european Seafood sector). The case concerns the co-management system of the bivalve fisheries in the Northern Adriatic region, which is to be considered a fully successful system because of the deep and virtuous interaction between local consortia and Producers’ Organisations in the resource management (Title: « Bivalve fisheries in Northern Adriatic: a successful integrated co-management system. Legal and normative issues. »). To what concerns the further goals of the research in Brest, it aims to analyse the role and concrete functioning of cooperatives and POs within Italian and French fish markets, both on the side of the resource management and on the side of market distribution, with a constant view on the common EU regulatory framework.
The first step should be an historic reference of the development of POs and fishery cooperatives in both countries, to outline differences and similarities. Then, the comparison between two parallel case studies which emerged from SUCCESS, namely PO Fasolari of Chioggia (Italy) and PO St. Brieux (France).The next step should be to integrate the study within the issues rising from Competition laws binding the economic operators acting both within national and EU markets. As well as using as a possible basis for comparing the implementation of the competition rules in the agricultural sector.
